ICAC indicts resident of Sheung Sze Wan Village, Sai Kung for reselling their “ding rights” to a developer

The Independent Commission Against Corruption said yesterday (23/10) that it had formally charged an indigenous resident of Sheung Sze Wan Village, Sai Kung with one count of “conspiracy to defraud”. He is accused of applying to build a small house in the village and falsely stated that it had no intention to sell the “ding rights” to other parties or developers.

After receiving the report and investigating, the ICAC found that the defendant is suspected of reaching an agreement with a developer, where the developer would build a house for him. After completion, the defendant could obtain the ownership of one of the units on the first floor of the small house, while the ownership of the remaining two-storey units would belong to the developer. The small house involved in the case was completed in 2021.

He was granted bail by the ICAC and will answer his plea at the Kwun Tong Magistrates’ Courts tomorrow (24/10).

According to the New Territories Small House Policy (Small House Policy), every male New Territories indigenous resident aged 18 or above can exercise the “Ding Right” once to apply to the Lands Department to build a small house for his or her own use within a recognised village in the New Territories. The “Ding Rights” are not transferable
